Terms of Service

1. Introduction

These Terms of Service ("Terms") govern the agreement between Lily Paw Digital ("we", "us", "our") and you ("the Client") when you purchase web design or web hosting services from us. By placing an order or making a payment, you confirm that you have read, understood, and agree to these Terms.

Lily Paw Digital is a web design and hosting company based in the North East of England. We build websites for small businesses and host them on our own infrastructure.

2. Our Services

2.1 What We Provide

Our standard web design and hosting packages include:

The specific features included in each package are set out on our website at lilypawdigital.xyz at the time of purchase.

2.2 What Is Not Included

Unless explicitly agreed in writing, our packages do not include:

3. Intellectual Property Rights

Your Content: You retain ownership of all content you create or upload to our services. You grant us a license to host, backup, and maintain your content as necessary to provide services.

Our Property: All materials, tools, templates, and code provided by Lily Paw Digital remain our intellectual property. You may not reproduce, distribute, or resell without permission.

3.1 Domain Ownership & Management

Important: Please read this section carefully. It explains who owns your domain name and what happens to it if you cancel your hosting.

3.1.1 If You Already Have a Domain Name

If you have an existing domain name that you would like to use for your new website, you will need to grant us access to your domain registrar account (or transfer management to us) so that we can point it to our hosting infrastructure. You remain the legal owner of your existing domain at all times.

3.1.2 If You Do Not Have a Domain Name

If you do not already own a domain name, we will purchase one on your behalf as part of your package. Domains purchased by Lily Paw Digital are registered in our name and remain our property for the duration of your hosting agreement.

This is standard practice for managed web packages and allows us to maintain full control over your hosting setup. It does not affect your ability to use the domain for your business.

3.1.3 Domain Transfer on Cancellation

If you cancel your hosting plan and would like to keep your domain name (where it was purchased by us on your behalf), we will transfer it to you at no additional charge, subject to the following process:

We will not withhold a domain transfer as a penalty or for any reason other than an outstanding balance. We want the process to be fair and straightforward for everyone.

3.1.4 Annual Renewal

Domain names registered by us are renewed annually at our cost while your hosting plan is active. If you cancel and choose not to have the domain transferred, we will allow it to expire and it will become available for registration by anyone.

5. CMS and Website Access

Your website is built and managed by us. We do not provide clients with access to the content management system (CMS), backend admin panel, or server directly. This allows us to keep your website secure, up to date, and performing well.

If you need changes made to your website content after launch, please contact us at support@lilypawdigital.co.uk and we will discuss options with you.

If you cancel your hosting and wish to receive a copy of your website files, we will provide these to you upon request, subject to all outstanding balances being cleared.

6. Cancellation

6.1 Cancelling Your Hosting

You may cancel your monthly hosting plan at any time. To cancel, contact us at support@lilypawdigital.co.uk. Cancellations take effect at the end of the current billing period — you will not be charged for the following month.

6.2 What Happens After Cancellation

Once your hosting is cancelled:

6.3 Cancellation of Design Projects

If you cancel a website design project before launch, any payments made are non-refundable unless otherwise agreed in writing at the time of your order. If work has not yet begun, we will discuss a fair resolution with you on a case-by-case basis.

7. Intellectual Property

The design and code of your website, including its visual design, layout, and structure, remains the intellectual property of Lily Paw Digital. Once your one-time design fee has been paid in full, we grant you a non-exclusive, perpetual licence to use the website for your business. This means you can use it, but you may not reproduce, resell, or repurpose the design for other projects or websites without our written permission.

If you cancel your hosting and wish to take your website elsewhere, you are welcome to do so using the files we provide. However, the underlying design remains ours and may not be used as a template or basis for a new website built by a third party without our consent.

You confirm that any content, images, logos, or text you provide to us for use on your website are owned by you or that you have the right to use them. You indemnify us against any claims arising from content you have supplied.

8. Limitation of Liability

We take the reliability of our hosting seriously and maintain our infrastructure to a high standard. However, no hosting service can guarantee 100% uptime, and we cannot be held liable for:

Our total liability to you in connection with these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of our services after that date constitutes acceptance of the updated Terms.

The current version of our Terms is always available at lilypawdigital.xyz.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
